Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Leander Property Appraisals ("we," "our," or "us") regarding your use of our website and services at leanderappraisals.com (the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.
Description of Service
Leander Property Appraisals provides professional property appraisal services in the Greater Toronto Area. Our Service includes:
- Online ordering and management of property appraisals
- Client portal for tracking appraisal orders
- Communication tools for coordinating appraisals
- Access to appraisal reports and documentation
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
User Accounts
To use certain features of our Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.
Appraisal Services
Ordering Process
When you place an order for an appraisal, you agree to provide accurate and complete information about the property and all parties involved. You are responsible for ensuring that all information provided is correct and that you have the authority to order the appraisal.
Acceptance and Completion
Submission of an order does not guarantee acceptance. We reserve the right to decline any order at our discretion. Once accepted, we will complete the appraisal in accordance with professional standards and applicable regulations.
Standard Turnaround
Our standard turnaround time is 3 business days, unless otherwise agreed upon. Turnaround times may vary based on property complexity, scheduling availability, and other factors beyond our control.
Payment Terms
Payment for appraisal services is due as specified in your order confirmation. We accept payment through the methods specified on our Service.
- All fees are non-refundable unless otherwise stated or required by law
- Late payments may result in suspension of services
- You are responsible for any taxes applicable to your purchase
- A cancellation fee may apply if the appraiser has already travelled to the property — see our Cancellation Fee Policy below
- We reserve the right to change our pricing at any time, with notice
Cancellation Fee Policy
A cancellation fee of $100 + HST ($113.00) applies when an order is cancelled after the appraiser has made a physical trip related to the assignment. This includes, but is not limited to:
- The appraiser travels to the property but is unable to gain access (missed appointment)
- The appraiser completes or partially completes an on-site inspection but the order is subsequently cancelled
- The appraiser travels to an address provided by the client that turns out to be incorrect
- The appointment is cancelled while the appraiser is already en route to the property
In short, any situation where the appraiser, through no fault of their own, has undertaken travel to or towards the property in connection with the order will qualify for the cancellation fee if the order is later cancelled.
How the fee is charged
When you place your first order, you are asked to provide a card on file. This card is securely stored by Stripe and is never stored on our servers. The cancellation fee will only be charged to this card if the conditions above are met and the order is cancelled. Your card will not be charged for any other purpose without your explicit consent.
Report delivery
If a cancellation fee has been incurred and you choose to continue the order rather than cancel, the fee will be added to your total balance. The appraisal report will not be released until the full balance, including any accrued cancellation fees, has been paid.
Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, images, and software, are the exclusive property of Leander Property Appraisals and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
Appraisal reports and related documentation are provided for your use in connection with the specific purpose for which they were ordered. You may not reproduce, distribute, modify, or create derivative works from appraisal reports without our written consent, except as permitted by law.
User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any portion of the Service
- Upload or transmit any viruses, malware, or other harmful code
- Collect or harvest information about other users without their consent
- Use the Service to transmit spam, chain letters, or other unsolicited communications
Disclaimers and Limitations of Liability
Service Availability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
Appraisal Reports
Appraisal reports are prepared in accordance with professional standards and are based on information provided by you and our inspection of the property. While we exercise professional judgment and care, we cannot guarantee the accuracy of all information provided by third parties.
Limitation of Liability
To the maximum extent permitted by law, Leander Property Appraisals shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
Indemnification
You agree to indemnify, defend, and hold harmless Leander Property Appraisals, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any inaccurate or incomplete information you provide
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date.
Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
